Raoul, III ORDINANCE NO. 9781 AN ORDINANCE CLOSING AND ABANDONING AN ALLEY LOCATED SOUTHEAST FROM O'NEAL STREET, NORTHEAST OF OAK STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located southeast from O'Neal Street, northeast of Oak Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by refer- ence: A 10 foot wide unopened alleyway beginning on the southeast line of O'Neal Street (as now widened) 140 feet northeast of the intersection of the southeast line of O'Neal Street (as now widened) with the northeast line of Oak Street, and extending southeast 170 feet between parallel lines and parallel to Oak Street. Said alleyway separates lots 25, 26, 27, and part of 27 1/2, from lot 28, subdivision of J. N. Trigg, Trustee, as shown by plat of record in plat book 4, page 29, R.O.H.C. Tax Map No. 156H-G-19. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
